Terms of service

Draft. This document describes the platform's actual contract surface but has not been reviewed by a lawyer. Run it past an Australian commercial/IT lawyer before going public, especially the liability cap and the consumer-law-compliant terms in clauses 4 and 8.
1. Accepting these terms
By creating a Roomfolio account or using the platform you agree to these Terms of Service and our Privacy policy. If you don't agree, don't use the service.
2. Eligibility
You need to be at least 18 years old, an Australian resident (or otherwise legally permitted to rent housing here), and provide accurate information when you sign up or post a listing. We can suspend accounts that don't meet these conditions or that submit falsified verifications.
3. Your account
- You're responsible for the activity on your account. Don't share your password.
- You can delete your account from Dashboard → Settings. Some data persists per our Privacy policy (anonymised public traces, payment records).
- We may notify, restrict, or suspend accounts that violate these terms. Severe or repeat violations result in a permanent ban.
4. Listings & team-ups
- You must own the right to list the property (as owner, head-tenant, or with the head-tenant's written consent).
- Photos must be yours or licensed to you. Stock photos of somewhere that isn't the actual property are not allowed and will be rejected in moderation.
- Price, bond, bills, and minimum stay must reflect what you'll actually accept. Bait-and-switch pricing leads to an account suspension.
- Team-ups represent real groups of people. Fake members, padded budgets, or sock-puppet accounts get the whole team rejected.
- We don't guarantee any listing will rent or that any team-up will find a place. The platform is a discovery and messaging surface, not an agency.
5. Messaging & reviews
- Messages are encrypted at rest. Don't share information you don't want the other participant to have.
- Reviews must be honest first-person accounts. We hide defamatory, off-topic, or retaliatory reviews when reported. Persistent abuse of the review system leads to a ban.
- Off-platform contact details (phone numbers, payment links, external chat handles) shared inside messages are automatically flagged and may be redacted. Keep the conversation here until you've met in person.
6. Featured slots & payments
- Featured slots are paid promotions processed via Stripe. Each suburb has a maximum of 4 concurrent featured slots.
- Slots are non-refundable once active. If we hide or remove your listing for a terms violation during an active slot, no pro-rated refund is owed.
- All amounts are in Australian Dollars (AUD), inclusive of applicable GST where listed. Stripe handles tax invoices.
7. Prohibited conduct
You agree not to:
- Harass, threaten, or discriminate against any user.
- Post listings that discriminate on race, religion, sexuality, gender identity, or disability beyond what the Australian Human Rights Act permits.
- Send unsolicited bulk messages, marketing, scams, or ask for deposits before any in-person inspection.
- Scrape the platform, automate account creation, or use the API in ways the documentation doesn't sanction.
- Upload malware, phishing pages, or anything else that compromises other users' security.
- Pretend to be someone you're not (real or fictional).
8. Liability
The platform is provided as-is. We do our best to verify identities and moderate listings, but we don't guarantee any specific outcome — that the place is as advertised, that the host is who they say they are, or that an arrangement will work out. Tour in person, never pay before you've signed a written agreement, and use your judgment.
To the extent permitted by Australian law, our total liability for any claim arising from your use of the service is capped at the greater of (a) the fees you've paid us in the 12 months preceding the claim, or (b) AUD 100. Nothing in this clause limits your rights under the Australian Consumer Law.
9. Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes are resolved in the courts of NSW unless mandatory consumer-law provisions apply.
10. Changes
When we change these terms materially, we'll notify you in the app + email at least 14 days before the new version takes effect. Continuing to use the platform after that counts as acceptance.
